Terms of Service

By creating an account or using DMXpressions™ ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

Protocol transparency: DMXpressions™ independently implements ANSI E1.31 (sACN) and publicly documented per-address priority behavior. It is not affiliated with, endorsed by, or certified by ESTA or ETC. Read the distributable protocol notice.

Upon purchase and redemption of a valid license key, Theatrically Jerry LLC grants you a non-exclusive, non-transferable, lifetime license to use DMXpressions™ for the tier purchased. License keys are single-use and bound to your account. Tiers differ in the number of DMX universes and features unlocked:

• Demo (free) — full console UI for evaluation with one universe for programming; live DMX output and the StageCraft3D are disabled.
• Student / Teacher, Personal, Commercial — unlock live DMX output and the StageCraft3D, with progressively higher universe limits (up to 128 universes of input and output). A valid student or educator ID is required for the Student tier.
• Commercial use — any use in a paid, commercial, rental, touring, or for-hire context requires the Commercial tier.

DMXpressions™ IS A CREATIVE TOOL, NOT A LIFE-SAFETY SYSTEM. DO NOT RELY ON IT AS THE SOLE CONTROL OF, OR SAFETY MECHANISM FOR, ANY EQUIPMENT WHERE FAILURE COULD CAUSE INJURY, DEATH, OR PROPERTY DAMAGE.

Lighting, pyrotechnics, rigging, lasers, fog/haze, and related stage equipment can be hazardous. You are solely responsible for the safe design, testing, operation, and supervision of your rig, including independent emergency-stop and blackout provisions, qualified operators, and compliance with all applicable codes, venue rules, and manufacturer instructions.

The Service runs in a web browser and depends on your device, browser, operating system, network, power, and third-party hardware — any of which may fail, lag, disconnect, or behave unexpectedly. Output timing is not guaranteed to be real-time. Always test your complete show on your actual hardware before any live use, and never run a performance without an independent manual override. Use of the Service in professional, theatrical, concert, broadcast, installation, or public environments is entirely at your own risk.

The Service can send control data to external equipment via a USB-DMX interface, an optional network output bridge, or other integrations. You are responsible for your own fixtures, interfaces, cabling, network configuration, and any software (including the bridge utility) you run. We do not warrant compatibility with any specific hardware, fixture profile, protocol implementation, browser, or operating system, and we are not liable for the behavior of third-party equipment or networks.

• You may not reverse-engineer, decompile, circumvent licensing in, or resell the Service.
• You may not share, transfer, or resell your license key or account.
• You may not use the Service for any unlawful purpose or in violation of any third party's rights.
• You may not use the Service in a manner that could endanger people or property (see Section 3).

DMXpressions™ is an offline-capable web app. When offline, you may be running a previously cached version that does not include the latest fixes; you are responsible for updating before relying on the Service. We may release updates and may modify, suspend, or discontinue the Service or any feature at any time without notice, and we do not guarantee any specific uptime. We are not liable for any modification, suspension, discontinuation, or for your use of an outdated cached version.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. Theatrically Jerry LLC expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no guarantee that the Service will be uninterrupted, error-free, real-time, or compatible with any specific hardware, fixture, protocol, network, or operating system.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THEATRICALLY JERRY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE OR ANY CONNECTED EQUIPMENT.

In no event shall our total aggregate liability to you exceed the amount you actually paid Theatrically Jerry LLC for your license in the twelve (12) months preceding the event giving rise to the claim.

This limitation applies regardless of the legal theory on which the claim is based, even if Theatrically Jerry LLC has been advised of the possibility of such damages. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.

All payments are processed by Stripe. License keys are digital goods delivered immediately upon purchase. All sales are final — no refunds are provided once a license key has been issued. If you experience a technical issue with key redemption, contact us at theatricallyjerry@dmxpressions.com and we will work with you in good faith.

You retain ownership of show data you create. By using the cloud save feature you grant Theatrically Jerry LLC a limited license to store and transmit that data solely to provide the Service. We do not claim ownership of your show files. You are responsible for maintaining your own backups of show-critical data.

The Service, including its software, design, branding, and content, is owned by Theatrically Jerry LLC and protected by intellectual-property laws. Your license grants a right to use the Service, not any ownership of it.

The Service relies on Supabase, Stripe, and our hosting platform. We are not responsible for the availability, accuracy, or conduct of these third-party services. Their respective terms of service and privacy policies apply.

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the jurisdiction where Theatrically Jerry LLC operates. You waive any right to a jury trial and agree to resolve disputes on an individual basis, not as part of a class action.

To use most features you must create an account. You agree to provide accurate information, to keep it current, and to be responsible for all activity that occurs under your account. You are responsible for safeguarding your credentials and any license key bound to your account; notify us immediately at theatricallyjerry@dmxpressions.com if you suspect unauthorized access. One person or entity per account unless otherwise agreed in writing.

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase a license or enter into these Terms. If you are between 13 and 18, you may use the free demo only with the involvement and consent of a parent, guardian, or educator. The Service is not directed to children under 13.

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you breach these Terms (including the Prohibited Use and safety provisions), if required by law, or to protect the Service or other users. We may do so without notice for serious or repeated violations. Upon termination, your right to use the Service ends; sections that by their nature should survive (including disclaimers, limitation of liability, intellectual property, and governing law) will survive. Termination for your breach does not entitle you to a refund.

We may label certain features as beta, preview, or experimental. Such features are provided "as is," may be changed or removed at any time, may contain bugs, and should not be relied upon for show-critical use. Your use of experimental features is entirely at your own risk.

If you send us ideas, suggestions, or feedback about the Service, you grant Theatrically Jerry LLC a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback for any purpose without obligation or compensation to you.

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Theatrically Jerry LLC and its officers, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) your use or misuse of the Service; (b) your connected equipment, rig, network, or any live event you run; (c) your violation of these Terms or of any law or third-party right; or (d) any injury or damage caused in whole or in part by your acts or omissions.

You represent that you are not located in, and will not use or export the Service in violation of, any applicable export-control or sanctions laws, and that you are not on any government restricted-party or denied-party list. The Service may not be used where prohibited by law.

We are not liable for any failure or delay in providing the Service caused by events beyond our reasonable control, including acts of God, natural disasters, power or internet failures, outages of third-party providers (such as Supabase, Stripe, or our hosting platform), labor disputes, war, terrorism, or government action.

You may not assign or transfer these Terms, your account, or your license without our prior written consent. We may assign these Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets. These Terms bind and benefit the parties and their permitted successors and assigns.

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with the Privacy Policy and any purchase terms, constitute the entire agreement between you and Theatrically Jerry LLC regarding the Service and supersede any prior agreements.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

All other product names, logos and brands are the property of their respective owners and are used for identification purposes only.
